PREAMBLE

BY USING THE UKRAINIAN.US WEBSITE, YOU CONFIRM THAT YOU ARE AWARE OF THE PURPOSES AND METHODS OF OBTAINING AND PROCESSING PERSONAL DATA, AND YOU GIVE YOUR CONSENT TO THE PROCESSING OF PERSONAL DATA AND PROVIDING THEM TO THIRD PARTIES IN ACCORDANCE WITH THE PROVISIONS OF THIS PRIVACY POLICY.

ALL DATA THAT YOU PROVIDE IS A NECESSARY CONDITION FOR CONCLUDING AN AGREEMENT ON THE TERMS OF USE OF THE UKRAINIAN.US WEBSITE AND MOBILE APPLICATION.

This Privacy Policy was developed on June 4, 2023, in accordance with the current legislation of Ukraine, including but not limited to the Law of Ukraine "On Protection of Personal Data" of June 1, 2010, No. 2297-VI, regarding the Users of the UKRAINIAN.US Platform, and establishes the procedure for obtaining, collecting, accumulating, storing, processing, using, ensuring protection and disclosure of Users' Personal Data.

References to the words "we", "our" or "us" (or words similar in meaning) refer to the UKRAINIAN.US Platform.

References to the words "you" or "your" (or words similar in meaning) refer to our User - Specialist or Client, depending on the context of the Privacy Policy.

This Privacy Policy sets out how we deal with certain Personal Data of Clients and Specialists.

We may change this Privacy Policy, so periodically check this page to make sure you are happy with the changes. Each time we update the information, we will post the date of the changes.

We do our best to comply with all the rules regarding the processing, storage, and collection of Personal Data, such as GDPR, as well as Ukrainian legislation related to Personal Data. The provisions of this Privacy Policy are made in accordance with the legislation of Ukraine, European legislation in the field of compliance with Personal Data (Regulation (EU) 2016/679 General Data Protection Regulation ("GDPR")), Directive on Privacy and Electronic Communications - ePrivacy Directive, and also comply with, adhere to and do not contradict the requirements of US legislation in the field of protection of Personal Data, in particular California Consumer Privacy Act (CCPA), Federal Privacy Act; Electronic Communications Privacy Act; Online Consumer Protection Act; Children's Online Privacy Protection Act - COPPA, as well as comply with, adhere to and do not contradict the requirements of Canadian legislation in the field of protection of Personal Data, in particular the Personal Information Protection and Electronic Documents Act - PIPEDA; Child Online Privacy Protection Act - COPPA; Canadian Anti-Spam Legislation - CASL.

TERMS AND DEFINITIONS

Data - any information directly or indirectly related to a specific User. The data includes: name, surname, email address, phone number, place of residence, time zone, interface language, device data (computer, browser type, mobile device operating system, access to the device's camera and microphone) used by the User, messages (information contained in correspondence) between Users, and also in correspondence with the Platform Administration), other information by means of which communication is carried out, which, at the User's request, is provided to them using the registration form and/or when filling out their profile on the Platform, when writing a message or review, or information received in another way.

Processing - any operation with Personal Data, automated or not, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction or destruction. Processing of Personal Data is understood to mean any actions with Personal Data, including, but not limited to: provision of access, dissemination, collection, systematization, storage, accumulation, recording, transmission, blocking, deletion, clarification, updating and/or alteration, depersonalization and other ways of using personal data by the Platform.

Personal data — information relating to you, alone or in combination with other pieces of information, enabling the person who collects and processes the information to identify you as an individual.

Data subject – a natural person or a person who can be identified, whose personal data is processed by the operator responsible for processing; denotes you as a User of the Platform.

Consent — freely given, specific, informed and unambiguous indication of the Data Subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of his Personal Data.

All other terms used in this Privacy Policy are defined in the Terms of Use of UKRAINIAN.US.

1. GENERAL PROVISIONS

1.1 The Platform does not process Data that belongs to racial, national origin, political views, religious and other beliefs, membership in public organizations.

1.2 Information characterizing the physiological features of users, on the basis of which their identity can be established, is also not processed.

2. WHAT DATA DO WE COLLECT AND PROCESS?

2.1 We may collect various types of data, both directly obtained from you upon registration (Article 13 GDPR), and obtained automatically, through your device (for example, personal computer, laptop, mobile phone) when you use the Platform Service (Article 13-14 GDPR). In accordance with the "data minimization" principle (Article 5(1)(c) GDPR), we collect and process only those Personal Data strictly necessary to provide you with UKRAINIAN.US Services.

2.2 UKRAINIAN.US may collect the Data listed below:

2.2.1 Client Profile. UKRAINIAN.US collects and processes Personal Data provided by you during registration and subsequent editing of your profile. For registration purposes, you provide registration data: user name and password, surname and email address, you can also edit your Profile and supplement it by providing information at your discretion. Additional information can help you receive targeted services. At the same time, you can not provide additional information not required during registration.

2.2.2 Information posted by Users as a result of their service. UKRAINIAN.US collects and processes information such as reviews, comments, appeals to Support Service, complaints, claims, and other appeals.

2.2.3 Information from the Personal Messages Service. UKRAINIAN.US may also process information provided by you, including the content of the Personal Messages Service, which you post on the Platform. You also acknowledge that your Content cannot be removed from the Services, as it may be associated with the Services you provide and used by other Users.

2.2.4 Information about transactions carried out using the UKRAINIAN.US platform. We do not directly process information about your credit/debit card, instead, we use a third-party payment service to invoice you for online payment. We do not store your payment information on our servers, such as the identifier, date, and time of the transaction.

3. WHAT PURPOSES DO WE COLLECT AND PROCESS YOUR DATA FOR?

3.1 UKRAINIAN.US collects and processes Personal Data for the following purposes:

3.1.1 We process your personal data to provide access to our services. We use your personal data during registration to help other users find your profile, order/provide a service, arrange an online/offline meeting. Please note that without the information you provide in accordance with our Terms of Use, you will not be able to use the functional capabilities of the Platform, communicate and interact with other Users, or provide/use User Services.

3.1.2 We may also use your card transaction data provided by a third-party payment service to confirm that a particular transaction has occurred, such as: the date and amount of your transaction and the last 4 digits of your card number, so that UKRAINIAN.US can verify your payment for Services.

3.1.3 We process certain payment information to comply with current financial and accounting legislation. We may also process data collected on the Platform in connection with legal requests we receive from you or any other competent person and/or body, and we may use this information to enforce and protect our legal interests.

3.1.4 We may use the Data in case of disputes and other issues related to the Services, (including communication) to resolve such issues, monitor User behavior on the Platform and respond to any complaints or requests.

3.1.5 We use User contact Data and payment information to establish, maintain, and conduct relationships with Users necessary for the Provision of Services. If a User does not provide the necessary personal data, we may be unable to fulfill our obligations in accordance with the provisions of the Terms of Use. We communicate with Users solely for obtaining information related to the Services.

3.1.6 Some information, such as your payment information and your behavior on the Platform, is subject to monitoring by UKRAINIAN.US, in order to prevent fraudulent activity on the Platform and to help you manage your Profile.

3.1.7 Certain Platform Services require access to components of your device, including the storage. When accessing this Service, a pop-up window appears asking to allow the Platform access to the relevant device component. You can adjust the permissions available in the device settings. If you forbid such access, these Platform Services may not function as intended.

3.2 UKRAINIAN.US may change the data processing purposes specified above, in which case we will inform you about the changes in the use and processing of your personal data within the new purposes. Notification of such changes will be sent to your email address. We will ask for your consent if the additional processing purpose is incompatible with those listed above.

3.3 If you do not wish to provide the Personal Data we request for the purposes stated above, you may not be granted access to the Platform Services.

3.4 UKRAINIAN.US does not collect or process your personal data unless you explicitly consent to it.

4. WHO CAN WE SHARE YOUR PERSONAL DATA WITH?

4.1 To provide high-quality services, UKRAINIAN.US employs staff, enters into contracts with independent contractors, and cooperates with other service providers, companies, and organizations that adhere to strict data processing agreements (DPA). For this reason, some of your personal data may be transferred to the specified individuals.

4.2 UKRAINIAN.US does not sell, transmit or disclose User Data, except as provided for by this Privacy Policy. We never collect and process your personal data without explanation and notification, and without your consent, unless we have notified you about this, and you have given us consent for such use.

4.3 In cases where there is no decision of the European Commission confirming an adequate level of data protection in accordance with Art. 45(1) of the GDPR, UKRAINIAN.US uses standard data protection clauses adopted by the European Commission in accordance with Art. 46(2)(c) of the GDPR, to ensure adequate safeguards of your rights and Personal data in case of third-party access or other data transfers.

4.4 UKRAINIAN.US may contain links to third-party websites, plugins, and applications. Clicking on these links or enabling these connections may allow third parties to collect or share data about you. When you leave UKRAINIAN.US, we recommend that you familiarize yourself with the privacy policy of each website/application you visit.

4.5 You agree that any information provided through the Services may be accessible to UKRAINIAN.US.

5. WHERE ARE PERSONAL DATA STORED AND HOW LONG ARE THEY PROCESSED?

5.1 In accordance with Article 5 (1)(b)(c)(e) of the GDPR, we adhere to the principles of "purpose limitation", "data minimization", "storage limitation", and therefore UKRAINIAN.US collects, stores, and otherwise processes only such information that is necessary to ensure our legitimate interests and to fulfill a legal obligation for the period necessary to satisfy our legitimate interests.

5.2 To determine the appropriate retention period for personal data, we consider the volume, nature, and confidentiality of the data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

5.3 If we do not need to process your data for the purposes set out in this Privacy Policy, we will delete your personal data from our systems. However, we may retain your Data for longer if we cannot delete them for legal or technical reasons, in which case we will ensure that your privacy is protected and your Personal Data are used only for purposes within the limits defined by this Privacy Policy.

5.4 The period during which we keep your personal information required to comply with obligations and legal norms varies and depends on the nature of legal obligations and claims in each particular case.

5.5 You have the right to delete your Profile after such a request, it will be permanently deleted from our active systems, servers, and backups within 30 (thirty) days. Upon deletion of the profile, all your personal data will also be deleted from the Platform, within 180 (one hundred and eighty) days.

6. OUR SECURITY MEASURES

6.1 In accordance with Article 5(1)(d)(e)(f) of the GDPR, we adhere to the principles of "accuracy", "storage limitation", and "integrity and confidentiality".

6.2 All personal data is stored on our third-party processors' secure servers in accordance with modern information security requirements. We use industry-recommended practices to ensure secure access to such data.

6.3 We use an appropriate level of technical and organizational measures to prevent accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to Personal Data on the Platform.

6.4 In the event of a data storage breach (for example, a leak), we are committed to conducting an investigation, promptly notifying the competent data protection authority, assessing the damages, and reporting the results of the investigation to all Users whose Personal Data have been compromised.

7 YOUR RIGHTS REGARDING YOUR PERSONAL DATA

7.1 In accordance with Article 5(1)(a)(d) of the GDPR, UKRAINIAN.US is committed to adhering to the principles of "lawfulness, fairness, and transparency", as well as "accuracy".

7.2 In accordance with the provisions of the Ukrainian Law "On Personal Data Protection", the GDPR, and the CCPA, we are committed to upholding your rights. Among them, you have the right to:

7.2.1 Access Personal Data according to Art. 15 of the GDPR - this allows you to gain access or receive a copy of your personal data that we store and check whether we process them lawfully;

7.2.2 Correction of Personal Data in accordance with Art. 16 of the GDPR - if you believe that any information about you that we have is inaccurate or incomplete, you have the right to request that we correct inaccurate personal information about you;

7.2.3 Deletion of personal data according to Art. 17 of the GDPR; CCPA - you can demand that we delete your personal data if you believe that:

7.2.3.1 we no longer need to process your personal data for the purposes for which they were provided;

7.2.3.2 we requested your permission to process your personal data, and you want to revoke your Consent.

7.2.4 Limitation of Processing of Personal Data in accordance with Art. 18 of the GDPR - you have the right to request a restriction on the processing of your personal data. This allows you to ask us to restrict the processing of your personal data if:

7.2.4.1 the data is incorrect;

7.2.4.2 the profile was used unlawfully, but you do not want us to delete it;

7.2.4.3 the profile is no longer relevant, but you want us to keep it for use in possible legal claims.

7.2.4.4 Please note that if you ask us to restrict the Processing of Personal Data, UKRAINIAN.US, will have to suspend the provision of Platform Services.

7.2.5 Data portability in accordance with Art. 20 of the GDPR; CCPA - you have the right to receive Personal Data you provided to us in a text format. You can also ask us to provide them to a third party if technically feasible. We are not responsible for such third party's use of your profile information, which will be governed by their agreement with you and any privacy statement they provided to you;

7.2.6 Objection to Processing of Personal Data according to Art. 21 of the GDPR;

7.2.7 Objection to automated processing (if any) of Personal Data according to Art. 22 of the GDPR;

7.2.8 Revocation of your Consent to the Processing of Personal Data, if applicable, according to Art. 7(3) of the GDPR - you can revoke your consent to the processing and use of your personal data at any time. Please note that in case of revocation of Consent, you will no longer be able to use the Services of UKRAINIAN.US;

7.2.9 Filing a complaint with your national supervisory authority in accordance with Art. 13(2)(d), 14(2)(e), 15(1)(f) of the GDPR, if you believe your privacy rights have been violated;

7.2.10 Receiving information about Personal Data according to CCPA that we have collected about you in the past 12 months. You can make such a request no more than twice within a 12-month period.

7.3 If you ask us to correct, erase personal data or restrict, stop processing or revoke your consent to the processing of personal data, we will notify you as soon as your request is satisfied, in accordance with Art. 13(2)(c), 14(2)(d), and 19 of the GDPR.

7.4 If your request is unresolved or resolved unsatisfactorily, you have the right to appeal to the local data protection authority in accordance with Art. 13(2)(d), 14(2)(e), 15(1)(f) of the GDPR.

7.5 You have the right to access your Profile and change information about yourself to the extent allowed by the system. You can also submit a request to change information about yourself by email: info@ukrainian.us.

7.6 If you wish to submit a request for the deletion of your personal data in accordance with the requirements of the GDPR, send a message to the email info@ukrainian.us. When submitting a request by email, you will be asked to provide identification and verification information.

8. COOKIES AND SIMILAR TECHNOLOGIES

Our website uses cookies. A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. Subsequently, the identifier is sent back to the server each time the browser requests a webpage from the server. Cookies can be either "persistent" or "session": persistent ones will be stored by the browser and will be valid until their expiration date, unless deleted by the user beforehand; "session" ones, on the other hand, will be deleted after the end of the website session or after the browser is closed. Cookies usually do not contain any information that identifies a user. However, your personal information that we have may be linked to the information stored and obtained from cookies. On our website, we use both persistent and session cookies.

On our website, we use Google Analytics and Adwords to recognize a computer when a user visits the website / track users' navigation on the website / improve the website's usability / analyze the use of the website / administer the website / prevent fraud and improve the website's security / targeted advertising that may be of interest to users.

Most browsers give you the ability to refuse to use cookies, for example:

In Internet Explorer (version 10) you can block cookies using the cookie handling settings available in the menu "Tools," "Internet Options," "Privacy," "Advanced";

In Firefox (version 24) you can block all cookies by clicking "Tools," "Options," "Privacy," selecting "Use custom settings for history" from the dropdown menu and unchecking "Accept cookies from sites"; and finally

In Chrome (version 29) you can block all cookies by accessing the "Settings and Management" menu, then selecting "Settings" - "Show advanced settings" and "Content settings", then selecting "Block sites from sending any data" under the "Cookies" heading.

Blocking all cookies will have a negative impact on the usability of many websites. If you block cookies, you will not be able to use many features on our website.

You can delete cookies that are already stored on your computer, for example:

In Internet Explorer (version 10), you have to manually delete cookies (instructions on how to do this can be found at http://support.microsoft.com/kb/278835);

In Firefox (version 24), cookies can be deleted by going to the menu "Tools," "Options," "Privacy," selecting "Use custom settings for history," clicking "Show Cookies," and then "Remove All Cookies";

In Chrome (version 29) you can delete all cookies by accessing the "Settings and Management" menu, selecting "Settings" - "Show advanced settings" and "Clear browsing data", and before that selecting "Delete cookies and other site and plug-in data".

Deleting cookies will have a negative impact on the usability of many websites.

9. CHILDREN'S PRIVACY (Article 8 GDPR)

9.1 We pay great attention to ensuring the privacy of children. The services of UKRAINIAN.US are not intended for use by children under the age of 18, without explicit permission from parents or guardians.

9.2 If you are under 18, you need to get parental/guardian permission before sending any personal data to UKRAINIAN.US. We may process Personal data of children under 18 provided that the Personal data are provided by parents/legal guardians in agreement with the explicit purpose of using the Services.

9.3 UKRAINIAN.US operates in accordance with the Children's Online Privacy Protection Act (COPPA). This law requires us to inform parents and legal guardians about how we collect, use, and disclose personal information from children under 13 years old.

9.4 We never knowingly collect, process, or request any information from persons under 18 years of age.

10. OTHER PRIVACY OBLIGATIONS

10.1 We will collect and use your Data only when we have a legal basis for doing so.

10.2 We will always act transparently and tell you about how we use your information. We will respect and uphold your rights, ensuring quick and transparent consideration of requests related to privacy issues.

10.3 We will not ask for more data than is necessary to provide our services.

10.4 If any of your rights concerning your personal data are violated, we will immediately notify you and the relevant data protection authorities about such cases, if there is a high risk of violation of your rights as a Data Subject. We will also do everything possible to minimize such risks.

10.5 We will also ensure that all our data processors have appropriate security measures, as well as contractual provisions requiring them to comply with our obligations.

11. LEGAL QUESTIONS

11.1 UKRAINIAN.US considers your use of the Services as your personal decision and your personal matter. However, we may disclose your personal data stored in our databases for the purpose of:

11.1.1 compliance with legislation or court order served on us;

11.1.2 enforcement and investigation of possible breaches of this Privacy Policy;

11.1.3 investigating potential fraudulent actions;

11.1.4 protecting the rights, property, or safety of UKRAINIAN.US, its employees, Users, or the public.

12. WARRANTIES AND LIABILITY

12.1 We do not guarantee error-free operation of the Services in accordance with this Privacy Policy. UKRAINIAN.US will make reasonable efforts to comply with the Privacy Policy and will take immediate corrective actions in case of violation or non-compliance with our Privacy Policy.

12.2 UKRAINIAN.US is not responsible for any incidental, indirect damages or fines associated with this Privacy Policy.

12.3 We do not control third-party websites and are not responsible for their privacy statements. We explicitly disclaim responsibility for their content, privacy policies, and terms of use and do not make any representations about their accuracy, content, or thoroughness.

12.4 In cases of changes or updates to the Privacy Policy, UKRAINIAN.US will always notify you on our Site and will indicate the update date.
